1.0 Booking COnditions
1. Booking Conditions
All bookings are made with Ethical Adventures (ABN: 45 759 315 390). By booking a trip with us you are deemed to have agreed to these Booking Terms + Conditions (which constitutes the entire agreement between you and us) and the booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.
Dates, itineraries and prices are valid as indicated on the specific webpage or marketing material.
If booking through a third party you may be required to pay a deposit for your booking. Recovery of this amount in the event of non-participation for whatever reason will be subject to the booking agents policies and may be non-recoverable. Bookings made direct to us do not require a deposit.
Acceptance of your booking will be confirmed by email and text. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due no later than immediately prior to departure on the day of trip. If this balance is not paid on or before this time we reserve the right to treat your booking as cancelled and you will be unable to participate in the tour for that day.
In order for us to confirm your travel arrangements, you must provide all requested details and the deposit (if required) at the time of booking. Necessary details include full name, age, nationality, any relevant pre-existing medical conditions (which may affect your ability to complete your travel arrangements or participate in our adventures), contact details, pickup location, food allergies and considerations.
If late for pickup we will attempt to contact you by the phone number. In the advent that you are unreachable and more than 10 minutes late it will be assumed that you are not attending and your seat will be cancelled. Any monies taken will be forfeit in this situation.
2.0 Payments
Private Charters – A 20% fee payable on booking confirmation. All monies finalised within 14 days of DEPARTURE.
PUBLIC Day tours and less – Paid at time of booking.
PUBLIC Extended tours – 20% of fee payable on booking confirmation. Full payment due within 14 days of departure..
3.0 Cancelations / refunds
Refunds and Cancellation
NOTE- There is NO special consideration given to COVID or any other health related factors.
Schedule 1 – If you/ your client circumstances change and you cannot undertake the tour:
3.1 DAY TOURS or less
- All items provided by ethical adventures and NOT third-party providers will be subject to no penalty if cancelations occur outside of 14 days from departure.
- All items provided by ethical adventures and NOT third-party providers will be subject to a 50% penalty of full payment if cancelled within 14 days to 48 hours prior to departure.
- All items provided by ethical adventures and NOT third-party providers will be subject to 100% loss of payment if cancelled within 48 hours of departure.
- For options provided by THIRD party providers such as accommodation, cruises, shows, flights etc any refund will be according to the terms of those providers policy. Ethical Adventures will pay to those providers the amounts owed where they require payment and refund the remaining amount to the guest.
3.2 MULTI DAY TOURS AND PRIVATE CHARTERS
- All items provided by ethical adventures and NOT third-party providers will be subject to no penalty if cancelations occur outside of 30 days from departure.
- All items provided by ethical adventures and NOT third-party providers will be subject to a 20% penalty of full payment if cancelled within 30 DAYS to 14 days prior to departure
- All items provided by ethical adventures and NOT third-party providers will be subject to a 50% penalty of full payment if cancelled within 14 days to 48 HOURS prior to departure.
- All items provided by ethical adventures and NOT third-party providers will be subject to 100% loss of payment if cancelled within 48 HOURS of departure.
- For options provided by THIRD party providers such as accommodation, cruises, shows, flights etc any refund will be according to the terms of those providers policy. Ethical Adventures will pay to those providers the amounts owed where they require payment and refund the remaining amount to the guest.
We recommend travel insurance.
Choosing to book through any means on an ethical adventures experience is done so with implied agreement of the above conditions.
3.3 Cancelation by ethical adventures
Ethical Adventures may cancel a trip due to but not limited to logistical or operational issues, insufficient sign-ups or any other cause that makes the trip unfeasible for us to operate. You will be advised as soon as possible by Ethical Adventures NT of the cancellation. If Ethical Adventures cannot facilitate your trip then we will endeavour to place you with another operator of our choosing which is agreeable to passengers.
If we do not find an alternative for you that is acceptable to you and us you will receive a full refund performed via internet transfer of funds to the source account of initial payment or cash payout. This amount will include any reservations monies paid to third parties such as Booking Agents and transaction fees paid by you for your tour with Ethical Adventures. This will constitute full settlement.
We may also cancel departures if forced to do so by circumstances such as fire, cyclones, industrial action etc. or what is commonly referred to as Force Majeure (FM). In the case of FM and Ethical Adventures, is forced to cancel a trip we will follow the Policy above. If you are unable to attend a tour due to FM and are forced to cancel then you will likewise be treated according to the same policy.
3.4 Early Termination of Tour due to weather and/or danger or otehr misc things
It is possible that a tour will be underway which may need to end prematurely due to environmental conditions such as flooding or severe storms. In such cases there is no refund issued.
4.0 Complaints and endorsements
Ethical Adventures relies on your feedback to ensure that all aspects of our adventures are to the highest standard and to help us achieve our goals, leaving you more than satisfied. For this reason, we encourage you to contact us via our email address and/or leave comments on our social media sites. Included in this are FACEBOOK, TRIP ADVISOR and LINKEDIN. Our choice to use online forms rather than paper forms reflects our commitment to maintaining a minimalistic paper use business.
If we do not find an alternative for you that is acceptable to you and us you will receive a full refund performed via internet transfer of funds to the source account of initial payment or cash payout. 5.0 Pricing and Payment
Our prices are based on Australian Dollars at the time of booking confirmation. All payments are to be made in Australian Dollars. They do include GST.
We accept credit cards directly and on our website booking window. Both incur a credit card fee of 1.9%. Bank Transfer is also an option to be done prior to the tour being undertaken. Bank details will be provided on request at time of confirmation of booking.
6.0 Age and Special Needs
All travelers under the age of 18 must be accompanied by an adult who is responsible for the child’s behavior whilst on tour. Children under 8 years of age are not suitable for our open set tours and as such will not be accepted for any set tour. When booking a charter tour it is possible in some circumstances to accommodate children under the age of 8 years old. This can be discussed at time of booking.
There is no upper limit for our adventures however due to the nature of the terrain and weather conditions we reserve the right to refuse on the day any passenger who we deem unable to fully and safely participate in that tours activities. In this case, the passenger will be subject to Refund Policy (Schedule 2). As a rule of thumb, you should be able to skip for 5 metres continuously without undue stress.
There are no age restrictions associated with Chartered Tours however fitness and flexibility levels, outlined above still apply.
6. Travel Insurance
Travel insurance is highly recommended. Your travel insurance should cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of AUS $200,000 for each of the heads of cover. Insurance for missing departure times for cruises is also recommended.
7. Change of Itinerary
Due to the nature of the environment and location of our adventures we may be required to alter the itinerary as previously represented with little or no prior notice being given to you. We will however attempt to inform you prior to departure as soon as is reasonably possible and offer to reschedule you on another trip or refund your payment if the changes are not to your liking.
We also reserve the right to alter the itinerary on any tour if in our view a better experience would be achieved by doing so.
We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.
8. Local Law & Authority on tour
Our adventures generally occur in remote, ecological important and culturally sensitive environments. For these reason and more all participants must act in accordance with local law and within the acceptable bounds of local customs whilst maintaining safety of all participants. Your guide will have final say on all matters likely to affect the safety or well-being of any person participating in the trip or the integrity of the locality. If you fail to comply with a decision made by your guide, or interfere with the well-being of the group, the group leader may order you to leave the trip immediately, with no right of refund.
9. Acceptance of risk
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the fauna, flora and geographical attributes present dangers and physical challenges greater than those present in our daily lives. However it is also your own responsibility to acquaint yourself with all possible relevant travel information and safety related information which will help you on your adventure with us. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks attendant upon such travel.
10. Limitation of Liability
We may contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
- any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded;
- you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and
- any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
- To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion) the provision of a similar trip to an equivalent value; or
- a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages
11. Optional Activities
Any activities not normally forming part of our adventures are not included in this contract. Although these may have been undertaken during our tour timeframe and via assistance from your guide you accept that any assistance given by your guide in arranging optional activities does not render us liable for them.
12. Errors & Omissions
We here at Ethical Adventures have made every effort to ensure that the content of this site is correct. However we cannot guarantee that we have not made mistakes so please bear that in mind as you scroll through the pages. We appologise for this and welcome your input to correct our oversight. By using this site, you acknowledge and accept that there may be errors in content and all information is provided for your interest only such that to the fullest extent permitted by law, Ethical Adventures and its employees will not be held responsible or liable for any loss, damage or other problems arising from use of, or inability to use, this site. Likewise links to third party sites are provided for your (the user) convenience.

The use of this website and these terms are subject to the laws of Australia and the jurisdiction of the Australian courts.
13. Feedback
Ethical Adventures relies on your feedback to ensure that all aspects of our adventures are to the highest standard, achieve our goals leave you more than satisfied. For this reason feedback forms are provided and encouraged to be completed by you so that we can address any issues, improve our products and take heart from your satisfied words.
Where a complaint has been lodged then Ethical Adventures NT will investigate the cause and seek to remedy the situation. In such cases you (the plaintiff) will be contacted to be informed of changes or the outcome of the complaint.
14. Severability
In the event that any Term or Condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such Term or Condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
15. Photos and Marketing
By participating in our Adventures you consent to Ethical Adventures using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes
If at the time of booking the trip you wish to void the consent given in 15(a) you will be required to state this in an email clearly stating ‘I do not give permission to use my image for any marketing material associated with Ethical Adventures NT’ at the time of booking. No exceptions.
16. Privacy Policy
Any personal information given to Ethical Adventures will remain private.
Any personal information gathered will never be sold to any third party for any reason. Ethical Adventures only collects personal information from visitors in order to process requests initiated by that person or their representative in order to perform a booking, payment or feedback. We may provide your details to our agents in order to facilitate your requested services from us.
Once your transaction with Ethical Adventures is completed you can request your personal details be deleted from our records.You may be contacted by Ethical Adventures in the future in regards to its activities. If you do not wish this to occur clearly state ‘ I do not wish to be contacted by Ethical Adventures NT in the future’ and we will delete your details from our records and only respond to your communications.

17. Applicable Law
The laws of the Northern Territory, Australia govern these Booking conditions and any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the Northern Territory, Australia.
